Have your say on Council's legislated By-laws review

How many dogs should you be allowed to keep? What sort of signs should businesses be allowed to put on the footpath? What activities should be allowed in Council's parks and gardens? Should camping be allowed on the side of Council's roads?

These are some of the issues that are regulated by Naracoorte Lucindale Council's By-laws which are currently being reviewed.

Council has a general power to make By-laws which are designed to provide good rule and governance and assist Council in providing a convenient, safe and comfortable space for its community.

Background

Council’s power to make a By-law is derived from Section 246 of the Local Government Act 1999 (SA) which requires the review and formal adoption of the By-laws. Council currently has five By-Laws.

It is a legislated requirement that Council reviews (and if necessary revises) its By-laws every seven years.

The By-laws have therefore been reviewed and some changes proposed. The vast majority of the proposed changes are minor in nature and a result of legislative, interpretive or grammatical factors. The outcome is the attached proposed By-laws.

Public Consultation

Copies of the proposed By-laws are available for inspection at Council offices and in the Documents Library at the top of this page.

In accordance with legislation, members of the public are invited to comment on the following proposed By-laws:

By-law No. 1 – Permits and Penalties 2024

A By-law to create a permit system for Council By-laws, to fix maximum and continuing penalties for offences, and to clarify the construction of Council By-laws.

By-law No. 2 – Local Government Land 2024

A By-law to manage and regulate the access to and use of Local Government land (other than roads), and certain public places.

By-law No. 3 – Roads By-law 2024:

A By-law for the management, control and regulation of certain activities on roads in the Council’s area.

By-law No. 4 – Moveable Signs 2024:

A By-law to set standards for moveable signs on roads and to provide conditions for the placement of such signs for the purpose of protecting visual amenity and public safety in the Council’s area.

By-law No. 5 – Dogs 2024:

A By-law to limit the number of dogs kept on premises and for the management and control of dogs in the Council’s area.
